§ 169A.283 — Stay of Execution of Sentence

A court can put a DWI sentence on hold (stay execution) if the person follows through with substance use disorder treatment recommended in their assessment. The court cannot stay the driver's license revocation.

Practical Notes
If you are convicted of DWI, the judge may let you avoid jail by completing treatment. But your license revocation still goes into effect regardless. If the judge does not follow the treatment recommendation, they must explain why on the record.
