§ 16B.991 — Termination of Grant

This law requires that every state grant agreement include a provision that the grant will be immediately terminated if the recipient is convicted of a crime related to the grant. It also gives the commissioner the power to end a grant early if continuing it would not serve the agency's purposes or is not in the state's best interest.

16B.991 TERMINATION OF GRANT.

Subdivision 1.Criminal conviction.

Each grant agreement subject to sections 16B.97 and 16B.98 must provide that the agreement will immediately be terminated if the recipient is convicted of a criminal offense relating to a state grant agreement. §

Subd. 2.Authority.

A grant agreement must by its terms permit the commissioner to unilaterally terminate the grant agreement prior to completion if the commissioner determines that further performance under the grant agreement would not serve agency purposes or performance under the grant agreement is not in the best interests of the state.

Practical Notes

Grant recipients should be aware that a criminal conviction related to the grant means automatic and immediate loss of funding. The commissioner’s authority to terminate grants early is broad and does not require the grantee’s agreement. These provisions apply to all grants subject to sections 16B.97 and 16B.98.
