§ 17.84 — Duties of Commissioner

Within 30 days of receiving the notice described in section 17.82, the commissioner must review the agency's proposed action, negotiate with the agency, and recommend in writing that the agency either carry out the action as proposed or follow an alternative. The commissioner's recommendations must follow the policy statement in section 17.80. If the agency gets no response from the commissioner within 30 days, that silence counts as a recommendation to proceed with the proposed action.

Practical Notes
The commissioner can recommend an alternative to the agency’s proposed action and must apply the farmland policy in section 17.80 when doing so. If the commissioner does not respond within the 30-day window, the agency may treat the lack of response as approval to proceed.
