§ 177.42 — Definitions

Plain-Language Summary

This section defines key terms for Minnesota's prevailing wage law. A 'project' means construction or improvement of public buildings or works paid for in whole or part with state funds. 'Prevailing wage rate' means the hourly pay plus benefits paid to the largest number of workers in the same trade in the area. Prevailing hours cannot exceed 8 per day or 40 per week.

Practical Notes
If you work on a state-funded construction project, you are entitled to the prevailing wage for your trade in your area. The prevailing wage includes not just your hourly pay, but also fringe benefits like health insurance, pension, and vacation pay. The wage must be at least a ‘reasonable and living wage.’
