§ 177.43 — Contracts for State Projects; Penalty

Contracts for state-funded construction projects must include the prevailing wage rates and hours for each trade. Workers on these projects cannot be paid less than the prevailing wage and must get overtime for hours beyond the prevailing hours. Violating these rules is a misdemeanor. The law does not apply to very small projects (under $2,500 for one trade, or under $25,000 for multiple trades).

Practical Notes
If you work on a state-funded construction project, the prevailing wage rates and hours must be posted at the job site. Contractors must submit certified payroll reports. If your employer pays less than prevailing wage, the commissioner can order the contracting authority to withhold payment to the general contractor until the violation is resolved.
