2025 Session Last amended: 2025 session

§ 181.9448 — Effect on Other Law or Policy

Plain-Language Summary

Addresses how the earned sick and safe time law interacts with other policies: employers may keep more generous leave policies, unused time need not be paid out at separation, accrued time is reinstated for employees rehired within 180 days, and accrued time carries through an employer succession.

Practical Notes
Employers may keep paid-time-off or leave policies that meet or exceed these requirements. Employers are not required to pay out unused earned sick and safe time when you leave, but if you are rehired within 180 days your unused time is restored. Accrued time also carries over if a new employer takes over the business.
