§ 190.08 — Military Staff; Active Duty Orders; Pay and Allowances

Plain-Language Summary

This section covers how the adjutant general staffs the Department of Military Affairs. The adjutant general can appoint assistant adjutants general, an executive director, a state quartermaster, and other officers. The adjutant general can order National Guard members to state active service for department administration, call up additional personnel during emergencies, hire civilian employees, and set pay according to federal armed forces rates.

Practical Notes
Staff members ordered to active service for more than one year gain job protection and cannot be removed except for cause, reduction in force, or loss of federal recognition. Temporary active service during emergencies does not create these protections. Pay for military staff follows federal armed forces pay scales for equivalent rank and service length.
