§ 204C.12 — Challenges to Voters; Penalty

Plain-Language Summary

Election judges must challenge a voter they personally know to be ineligible. Authorized challengers and other voters may also challenge someone based on personal knowledge. A challenged voter is placed under oath and asked questions about residency and eligibility. If the voter refuses to answer or sign the roster, they cannot vote. An election judge who fails to carry out these duties is guilty of a gross misdemeanor.

Practical Notes
Challenges must be based on personal knowledge, not guesswork. If you are challenged, you will be asked questions under oath. If your answers show you are eligible, you can vote after signing a voter certificate. If you refuse to answer, you will not be allowed to vote.
