§ 204C.36 — Recounts in County, School District, and Municipal Elections

Plain-Language Summary

Losing candidates in close county, school district, or municipal races can request a free recount if the margin is small enough. Thresholds vary by total votes cast. Candidates may also request a self-funded recount even when the margin is larger. Ballot question recounts can be requested by 25 eligible voters. If the recount changes the winner, the jurisdiction pays the cost.

Practical Notes
Recount requests have strict deadlines: by the fifth day after a primary canvass or the seventh day after a general election canvass. You must file with the county auditor for county offices or the municipal/school district clerk for those offices. If you pay for a discretionary recount that overturns the result, the jurisdiction reimburses you.
