§ 214.077 — Temporary License Suspension; Imminent Risk of Serious Harm

Plain-Language Summary

When a health licensing board has probable cause to believe a licensed professional has violated a law and continued practice poses an imminent risk of serious harm, the board must temporarily suspend the person's license. A contested case hearing must be scheduled within 30 days. The administrative law judge must issue a report within 30 days after the hearing.

Practical Notes
A temporary suspension takes effect immediately upon personal service or three days after mailing. If you receive a temporary suspension order, you have the right to a contested case hearing within 30 days. If the board does not issue a final order within the required timeframe, the suspension is lifted, unless you requested a delay.
