§ 223.16 — Definitions

Plain-Language Summary

This section defines the key terms used throughout Minnesota's grain buyer licensing law. A 'grain buyer' is someone who buys grain to resell it or make products from it, but not someone buying feed for their own livestock or seed for their own crops. A 'voluntary extension of credit contract' is any arrangement where the farmer delivers grain but payment or price is set later, including deferred payment, no-price-established, and average pricing contracts. A 'cash sale' requires full payment by the end of the next business day.

Practical Notes
These definitions determine who must be licensed and what type of contract a grain transaction falls under. Farmers who sell grain should understand whether their sale is a ‘cash sale’ or a ‘voluntary extension of credit contract,’ since the two have very different legal protections and documentation requirements. Grain buyers who purchase seed grain or feed for their own animals are not subject to the Grain Buyers Act.
