§ 241.01 — Creation of Department

This law creates the Minnesota Department of Corrections and sets up the job of the commissioner of corrections. The commissioner runs all state prisons and correctional programs, hires staff, manages budgets, and decides where inmates are housed. The commissioner must also set goals each year, accept gifts and grants, and can let outside groups use correctional facilities.

Practical Notes
The commissioner has wide power over all state correctional facilities, including the ability to transfer staff and reorganize programs. After July 1, 2023, inmates who have not been conditionally released cannot be housed in privately run facilities. The commissioner cannot close the St. Cloud correctional facility without approval from the legislature.
