§ 244.08 — Supervised Release Board

Plain-Language Summary

This law defines the powers of the Supervised Release Board. For crimes committed after May 1, 1980, the board's powers are limited to those described in the sentencing guidelines chapters. For crimes committed before that date, the board keeps its full traditional parole and release powers. The board must consider the sentencing guidelines but is not bound by them for older cases.

Practical Notes
The May 1, 1980 date is critical because it marks when Minnesota shifted from indeterminate to determinate sentencing. Inmates sentenced for pre-1980 crimes may still be subject to traditional parole board decisions. The board’s existing powers are preserved unless they directly conflict with the sentencing guidelines statutes.
