§ 244.18 — Correctional Fees; Schedule, Collection, and Use

Plain-Language Summary

Probation agencies and the Commissioner of Corrections can charge fees for correctional services like drug testing, electronic monitoring, and treatment programs. Fees must be based on the person's ability to pay and the actual cost of services. If a person cannot afford the fee, it must be waived or community service can be substituted. Supervision fees are being phased out by August 1, 2029.

Practical Notes
Restitution payments must come before correctional fees. Supervision fees cannot be increased between August 1, 2023, and July 31, 2029, and all supervision fees must be phased out by 2029. Sex offender treatment providers may charge co-pays on a commissioner-approved schedule. Fees collected generally stay in the county where supervision is provided.
