§ 25.43 — Penalties

Plain-Language Summary

This section establishes civil and criminal penalties for violations of the Minnesota Commercial Feed Law. Civil penalties may be assessed for each violation and are paid to the state. Criminal penalties, including fines and possible imprisonment, apply to knowing or willful violations. The commissioner may also seek injunctions to stop ongoing violations.

Practical Notes
Penalties under the Commercial Feed Law can be substantial, especially for repeat or willful violations. Businesses that discover they have been selling noncompliant products should self-report to the Department of Agriculture and take corrective action — voluntary disclosure is typically treated more favorably than violations discovered during inspection. Civil penalties assessed by the department can be challenged through an administrative hearing.
