§ 253D.10 — Temporary Confinement

Plain-Language Summary

This section governs where a person can be held while a sex offender commitment petition is pending. Generally, the person must be held in a secure treatment facility, but under limited circumstances they may be held in a jail for up to 24 hours. A person still serving a prison sentence may voluntarily elect to stay in a correctional facility during the commitment process, but must be transferred to a secure treatment facility when their sentence ends.

Practical Notes
The rules about where someone is held during commitment proceedings have significant practical implications. People who are in prison when a commitment petition is filed can elect to stay in the prison environment during the process, but this election can be revoked. Once a prison sentence ends, the person must be moved to the Minnesota Sex Offender Program’s secure facility if committed.
