§ 253D.22 — Transfer to Correctional Facility

Plain-Language Summary

This section governs what happens when a person committed to the sex offender program is also sentenced to prison for a new crime or has their conditional release revoked. They must be transferred to a correctional facility to serve that sentence first. After completing the prison sentence, they return to the Minnesota Sex Offender Program for continued treatment.

Practical Notes
People who are civilly committed and then commit a new crime face both the prison sentence for the new crime and continuing civil commitment afterward. The civil commitment remains in force during the prison sentence and does not expire while the person is incarcerated. Attorneys representing someone in this situation must navigate both the criminal and civil commitment systems simultaneously.
