§ 256R.04 — Prohibited Practices

Plain-Language Summary

Nursing facilities that want Medical Assistance payments must not charge extra fees for admission, require loans from residents, demand inheritance promises, or require third-party payment guarantees. Facilities also cannot discriminate based on a resident's payment source or force residents to use specific medical vendors.

Practical Notes
Violations can result in a payment rate reduction of up to 20 percent. Facilities that demand kickbacks from medical vendors face treble damages (three times the excess payments). Residents cannot be refused readmission after a hospital stay for more than 24 hours. Facilities have 20 days to fix violations after receiving an order from the commissioner.
