§ 256R.54 — Ancillary Services

Plain-Language Summary

The commissioner sets payment rules for ancillary services like therapy and pharmacy provided to nursing facility residents. Payment for the same service cannot go to both the nursing facility and an outside vendor. Space rental arrangements between facilities and vendors must be at fair market value.

Practical Notes
This prevents double billing by ensuring each service is paid only once, either through the facility’s daily rate or a separate vendor payment. The commissioner audits cost reports to verify compliance. Rental arrangements between facilities and ancillary service vendors must reflect fair market value and cannot include kickbacks or referral payments.
