§ 256R.48 — Publicly Owned Facilities

Nursing facilities owned by a city, county, or hospital district can apply for a higher payment rate if the local government agrees to pay its share of the extra Medicaid cost. The higher rate must stay within federal Medicare upper payment limits.

Practical Notes
Applications must be submitted by September 30 for participation starting January 1. The public entity must pay the entire nonfederal share of the increased rate. This draws down additional federal Medicaid matching funds. The commissioner can reduce payments at any time if they would exceed federal limits. Federal approval is required before rates take effect.
