§ 256R.51 — Rate Adjustment for Special Dietary Needs

Nursing facilities with special dietary requirements for their residents, such as kosher or halal food, can receive a rate adjustment if their food costs exceed 115 percent of the statewide median. The extra cost is moved from the care-related rate to the external fixed costs rate.

Practical Notes
This protects facilities serving populations with religious or cultural dietary needs from being penalized in the rate-setting process. The facility must meet the requirements of sections 31.651 or 31.658 for special dietary food. The adjustment is excluded when comparing facilities for future rate calculations.
