§ 256R.52 — Nursing Facility Receivership Fees

Plain-Language Summary

When a nursing facility is placed in receivership, the commissioner can add a receivership fee to the facility's payment rate to cover the extra costs. If the facility is later sold, the prior owner must repay these fees to the state within 60 days.

Practical Notes
The receivership fee is calculated per resident day based on estimated additional costs. The fee takes effect on the first day of the receivership. The commissioner can make lump-sum payments to the receiver and arrange a repayment plan. Private-pay residents who paid the receivership fee must also be reimbursed by the prior licensee. New owners receive the pre-receivership payment rates.
