§ 256R.06 — Private Pay Residents; Required Practices

Plain-Language Summary

Nursing facilities cannot charge private-pay residents more than the Medical Assistance rate for similar services, and the Medical Assistance rate cannot exceed what private-pay residents are charged. Facilities must give 30 days' written notice before raising private-pay rates.

Practical Notes
This prevents two-tier pricing where private-pay residents subsidize Medicaid residents or vice versa. Facilities can charge more for private rooms and for optional special services. Violations can lead to treble damages (three times the overcharge). At admission, facilities must inform residents and spouses about their rights to retain certain resources if they later apply for Medical Assistance.
