§ 257.75 — Recognition of Parentage

Plain-Language Summary

Provides the process for unmarried parents to voluntarily establish paternity by signing a Recognition of Parentage form before a notary public and filing it with the state registrar. Once properly executed, the recognition has the force and effect of a court judgment establishing paternity.

Practical Notes
The Recognition of Parentage (ROP) is the most common way unmarried parents establish paternity in Minnesota, often completed at the hospital after birth. Key points: (1) The ROP can be revoked within 60 days of signing. (2) After 60 days, it can only be vacated by court action based on fraud, duress, or material mistake of fact. (3) The ROP alone does not grant the father custody or parenting time rights – he must file a separate court action. (4) If a married woman’s spouse is not the biological father, the spouse must execute a joinder renouncing his presumption.
