§ 259.59 — Effect of Adoption

Plain-Language Summary

Establishes that upon adoption, the adopted person becomes the legal child of the adoptive parents with full rights and duties, including inheritance. Birth parents are relieved of all parental responsibilities and lose all rights over the adopted person.

Practical Notes
After the adoption decree is entered, the adoptive parents have the same legal rights and responsibilities as birth parents, including the right of the adopted person to inherit. The birth parents lose all parental rights and the adopted person no longer inherits from birth parents. An exception applies to stepparent adoptions, which do not change the child’s relationship with the birth parent who is the stepparent’s spouse.
