§ 268A.03 — Powers and Duties

Plain-Language Summary

This section lists the commissioner's powers and duties for vocational rehabilitation and independent living programs. These duties include certifying community rehabilitation providers, providing vocational rehabilitation services, spending funds on rehabilitation facilities, making disability determinations under Social Security agreements, conducting research and training, accepting and disbursing federal funds, creating state plans, cooperating with other agencies, and adopting rules.

Practical Notes
This section is the primary authority for the state’s vocational rehabilitation program and connects Minnesota law to the federal Rehabilitation Act. Persons with disabilities receiving vocational rehab services have the right to choose their own physician, dentist, or prosthetic/orthotic provider. Organizations wishing to provide rehabilitation services or apply for grants should look to this section for the commissioner’s authority.
