§ 268B.09 — Employment Protections

Plain-Language Summary

This section protects employees who use paid leave from retaliation by their employer. Employers cannot fire, discipline, or punish workers for requesting or taking leave. When you return from leave, you have the right to get your same job back or an equal one with the same pay and benefits. Your employer must also keep your health insurance active during leave.

Practical Notes
These protections apply after 90 days of employment. If your employer retaliates against you, they can face penalties of $1,000 to $10,000 per violation. You have the right to sue your employer for damages, attorney fees, and reinstatement. You cannot be forced to waive these rights, and you cannot be forced into arbitration. Your employer must keep your health insurance going while you are on leave.
