§ 270C.7109 — Authority to Release Levy and Return Property

The commissioner can release a levy if the tax is paid, a payment agreement is reached, the levy is causing economic hardship, or the value of the property exceeds the amount owed. Property wrongfully levied on can be returned.

Practical Notes
If a levy is causing you serious financial hardship, you can ask the commissioner to release it. Setting up a payment plan may also result in the levy being released.
