2025 Session Last amended: 2023 session

§ 299A.52 — Responsible Party

Plain-Language Summary

The person or company responsible for a hazardous materials incident must pay the reasonable costs of the emergency response, including legal and administrative expenses. The commissioner can sue to recover unpaid costs. Responsible parties cannot avoid liability by transferring property or signing hold-harmless agreements.

Practical Notes
This cost recovery provision ensures that taxpayers do not bear the costs of emergency responses caused by private parties. The commissioner assesses costs and can go to court to collect. Any recovered funds go to the commissioner to cover response costs, with leftovers transferred to the Fire Safety Account.
