§ 3.8855 — Tax Expenditure Review Commission

This section creates the Tax Expenditure Review Commission to review Minnesota's tax expenditures and evaluate their effectiveness and fiscal impact. The commission has nine members (eight legislators appointed by leadership of both chambers plus the commissioner of revenue or a designee), and it must review every tax expenditure on a rotating basis at least once every ten years, with an initial review of all expenditures completed within three years of establishment. For each expenditure it estimates revenue lost, measures effectiveness against the stated objective, and recommends whether to continue, repeal, or modify it. The commission must submit a written report to the legislative tax committees by February 15 each year.

Practical Notes
This section is in effect and was last amended in 2025. The commission must hold a public hearing on an expenditure before February 1 of the year it is included in a report, and the Department of Revenue’s research division must supply the summary data needed to complete the reviews. Appointing authorities make their appointments by January 31 of the odd-numbered year, and members serve until the start of the regular legislative session in the next odd-numbered year.
