§ 325D.04 — Selling Below Cost Forbidden

Retailers, wholesalers, and vending machine operators in Minnesota cannot sell goods below their actual cost if the purpose is to hurt a competitor or destroy competition. Selling below cost in one area while charging more elsewhere is also banned.

Practical Notes
If you own a business, you cannot use extremely low prices as a weapon to drive competitors out of business. You can offer lower prices if they reflect real differences in your costs, or if you are matching a competitor’s legal price in good faith.
