2025 Session Last amended: 2006 session

§ 325E.61 — Data Warehouses; Notice Required for Certain Disclosures

Plain-Language Summary

Requires businesses that own or license personal information to notify Minnesota residents of data breaches. 'Personal information' includes a name combined with a Social Security number, driver's license number, or financial account number with access codes. Notification must be made without unreasonable delay.

Practical Notes
This is Minnesota’s primary data breach notification statute. Businesses must notify affected individuals and, if more than 500 people are affected, must also notify nationwide consumer reporting agencies within 48 hours. Waivers of this section are void and unenforceable. The attorney general enforces this law under section 8.31.
