§ 325F.665 — New Motor Vehicle Warranties; Manufacturer's Duty to Repair, Refund, or Replace

Minnesota's 'Lemon Law' for new motor vehicles. If a manufacturer cannot fix a substantial defect after a reasonable number of repair attempts, the consumer is entitled to a replacement vehicle or a full refund of the purchase price. Applies to passenger cars, pickup trucks, vans, and certain recreational vehicles and ambulances.

Practical Notes
A defect is presumed unrepairable if the same problem persists after four or more repair attempts, or the vehicle is out of service for 30+ business days. For brake or steering failures likely to cause death or serious injury, one failed repair is enough. Consumers must first use the manufacturer’s arbitration program before suing, and must file any lawsuit within three years of original delivery.
