2025 Session Last amended: 1986 session

§ 325F.67 — False Statement in Advertisement

Plain-Language Summary

Makes it a misdemeanor and a public nuisance to publish any advertisement containing untrue, deceptive, or misleading statements about merchandise, securities, or services, regardless of whether anyone was actually harmed. Covers all media including print, radio, television, and internet.

Practical Notes
Unlike the Consumer Fraud Act (325F.69), this is a criminal statute – violators can be charged with a misdemeanor. No actual harm to any person is required. Both the attorney general and the county attorney where the violation occurred have a duty to prosecute. The deceptive advertising can also be enjoined as a public nuisance.
