§ 336.2-313 — Express Warranties by Affirmation, Promise, Description, Sample

Plain-Language Summary

When a seller makes a specific promise, describes the goods, or shows a sample, those statements become express warranties. The goods must match what the seller said, even if the seller never used the word 'warranty.'

Practical Notes
If a car dealer tells you a vehicle has never been in an accident, or a product listing describes specific features, those statements are legally binding warranties. Save ads, brochures, and written descriptions as evidence.
