§ 336.2-315 — Implied Warranty; Fitness for Particular Purpose

Plain-Language Summary

If a seller knows the buyer needs goods for a specific purpose and the buyer relies on the seller's expertise to choose the right product, there is an implied warranty that the goods will be fit for that purpose.

Practical Notes
This warranty applies when you tell a seller what you need a product for and rely on their recommendation. For example, if you tell a paint store employee you need paint for outdoor use in Minnesota winters and they recommend a product that peels in cold weather, this warranty may be breached.
