§ 336.2-723 — Proof of Market Price; Time and Place

Plain-Language Summary

If an anticipatory repudiation goes to trial before the delivery date, damages are measured by the market price at the time the repudiating party learned of the repudiation. Evidence of market price at any commercially reasonable substitute time can be used.

Practical Notes
If someone backs out of a deal before the delivery date, damages are based on the market price when they learned of the breach.
