§ 336.3-105 — Issue of Instrument

Plain-Language Summary

An instrument is payable to 'order' if it says 'pay to the order of' a named person. An instrument is payable to 'bearer' if it says 'pay to bearer' or does not name a specific payee.

Practical Notes
Whether a check is ‘pay to the order of John Smith’ or ‘pay to bearer’ affects how it can be transferred.
