§ 336.3-109 — Payable to Bearer or to Order

Plain-Language Summary

An instrument payable to a named person is a 'promise to order.' An instrument not payable to a named person is a 'promise to bearer.' An instrument can start as one and convert to the other through endorsement.

Practical Notes
Whether a check or note is payable ’to order’ or ’to bearer’ affects who can cash it and how it transfers.
