§ 336.3-110 — Identification of Person to Whom Instrument is Payable

Plain-Language Summary

An instrument can identify the payee by name, office, account number, or other description. If ambiguous, the instrument can be negotiated by any identified person. If payable to two or more persons with 'and,' all must endorse; if with 'or,' any one can.

Practical Notes
A check payable to ‘John and Mary’ requires both signatures to cash; a check payable to ‘John or Mary’ can be cashed by either one.
