§ 336.3-308 — Proof of Signatures and Status as Holder in Due Course

Plain-Language Summary

The signer of an instrument can assert defenses and claims in recoupment against the person entitled to enforce. A holder in due course is not subject to defenses of other parties except 'real' defenses.

Practical Notes
If someone sues you on a promissory note, you can raise defenses like ’the goods were defective.’ But these defenses may not work against a holder in due course.
