§ 336.3-405 — Employer's Responsibility for Fraudulent Endorsement by Employee

Plain-Language Summary

If an employer entrusts an employee with responsibility for instruments and the employee makes a fraudulent endorsement, the endorsement is effective. The loss falls on the employer, not on later good-faith takers.

Practical Notes
If your employee handles checks and fraudulently endorses one, your business bears the loss, not the bank.
