§ 336.3-406 — Negligence Contributing to Forged Signature or Alteration of Instrument

Plain-Language Summary

If a person's negligence substantially contributes to a forged signature or alteration of an instrument, they cannot assert the forgery or alteration against a person who paid in good faith or collected the instrument.

Practical Notes
If your carelessness helped cause a check forgery (like leaving blank signed checks lying around), you may not be able to blame the bank for paying the forged check.
