§ 336.4-302 — Payor Bank's Responsibility for Late Return of Item

Plain-Language Summary

If a payor bank is properly presented with a demand item and does not pay or return it by its midnight deadline, the bank becomes 'accountable' and must pay the item. This is the 'final payment by accountability' rule.

Practical Notes
If a bank holds a check past its midnight deadline without returning it, the bank must pay it – even if the account has insufficient funds.
