§ 336.9-404 — Rights Acquired by Assignee; Claims and Defenses Against Assignee

Plain-Language Summary

An account debtor can assert against an assignee any defense or claim it could assert against the original creditor, if the defense arose before notification of the assignment.

Practical Notes
If your debt is assigned to a new creditor, you can raise the same defenses against the new creditor that you could have raised against the original.
