§ 359.01 — Commission

This section explains how notaries public are appointed in Minnesota. The governor appoints notaries with senate approval. You must be at least 18 and a Minnesota citizen or resident alien. Nonresidents from neighboring states can also be appointed under certain conditions.

Practical Notes
To become a notary in Minnesota, you apply through the Secretary of State and pay a $120 fee. A notary commission does not give you any special legal immunity. If you want to notarize documents electronically, you must register separately.
