§ 363A.20 — Exemption Based on Employment

Certain situations are exempt from the employment discrimination rules. The law does not apply to a person employed by their own parent, grandparent, spouse, child, or grandchild, or to domestic service workers. It also sets rules for when employers can require medical exams (only after a job offer, and only for job-related abilities), and establishes that bona fide seniority systems are generally allowed.

Practical Notes
Even though Minnesota law broadly prohibits employment discrimination, there are limited exceptions. For example, a family business can hire family members, and employers can require medical exams after making a conditional job offer.
