§ 363A.42 — Public Records; Accessibility

Plain-Language Summary

Public records from state and local government must be made available in accessible formats for people with disabilities when requested. Violations can result in penalties of $500 per violation, plus attorney fees, up to a $15,000 cap.

Practical Notes
If you have a disability and need government records in an accessible format (such as large print, audio, or electronic text), the government must provide them within a reasonable time. If they refuse, you can sue for $500 per violation plus attorney fees, but the total is capped at $15,000. You must file your claim within one year.
