§ 364.03 — Relation of Conviction to Employment or Occupation

Plain-Language Summary

A person cannot be turned down for a government job or a licensed occupation just because of a criminal record, unless the crime is directly related to that job or license. If the crime is related, the person can still qualify by showing evidence of rehabilitation.

Practical Notes
The employer or licensing authority must consider the nature and seriousness of the crime, how it relates to the job, and whether the person has been rehabilitated. Evidence of rehabilitation includes release documents, training, work history, and community references.
