§ 394.33 — Town Powers

This section preserves towns' existing planning and zoning powers, but after a county adopts official controls, towns cannot have zoning rules that are less strict than the county's. Towns can adopt rules that are stricter than the county's, including tighter shoreland regulations.

Practical Notes
Towns must record their zoning ordinances with the county recorder. A town with statutory city powers keeps its authority to plan and zone, but its rules cannot be weaker than the county’s zoning standards. Towns that want county planning services can request them under section 394.32.
